the scene and gathering evidence, even taking a few things from inside. that injured firefighter treated at the scene. the elderly man taken to a hospital for a mental health evaluation. police still not sure what set this off. they say when they get to the bottom of all this, they will determine what charges will be filed. reporting live in berkeley, christie smith, "today in the bay." in just a few hours from right now, the parents of a teenage girl who killed herself after an alleged sexual assault will share their story publicly for the very first time. audrie pott, her family first spoke about the 15-year-old's tragic death to nbc bay area just last week. today, the attorney says he is planning to file a wrongful death suit against three 16-year-old boys accused in the sexual assault. the pott family says photos were sent out bisect message and e-mail to several students at her school, saratoga high school. the family is also pushing for a law to try and prevent anything

like this from ever happening again. "today in the bay's" bob redell will have a preview for the tough penalties and what they would call for. >> san jose police are looking for a driver that hit an officer just outside his car. the officer has just been released from the hospital. mar marla tallez joins us. >> reporter: vincente fernandez had just wrapped up his concert at hp pavilion. if you have ever been to a sold-out event, you know these things can get very congested and pretty chaotic afterward. that was the scene when the suspect came flying out of this overflow parking lot in his car. he struck the officer right here at the intersection of delmas and san fernando. police say the suspect had just broken into a parked car when he was caught by the vehicle's owner. so he didn't get away with any of the owner's belongings. this is about 11:30 last night.

the suspect then jumped into his own car, a late model black four-day acura tl. police say he was speeding down delmas the wrong way when he hit the officer that was directing traffic. lieutenant mike sullivan tells us he is not sure if it was a random crime or a crime of opportunity. >> at this point, all we know is that one victim was identified. he came upon the car after the concert, saw someone in it. the person gave back the property to the suspect. he ran to a different vehicle and then took off out of the parking lot at a high rate of speed, 30, 40 miles an hour and struck the officer. lieutenant sullivan says that officer was taken to the hospital with a broken leg but the good news is, he has been released and he will be okay. the suspect, however, is still on the run. he is described as a hispanic man with curly hair. last seen driving a late model

clearing and no lanes are blocked. that's the good news. also, 92 approaching the toll plaza. shows the yellow. speeds starting to slow in typical spots for 880 and 238. east 580, unusual slowing. we had an earlier report of a truck fire there. there itss a waste management truck there. that continues with the build, a slower drive eastbound over towards the 685/580 interchange. there is your commute slowing for 580 as well as 84. a pretty typical commute. southbound. a typical. unusual slowing from danville down to san ramon. a crash blocking one area. as you come through danville, it

slows and slams on the brakes. there is not a great alternate, except if you hit city streets. we will get you a live look at the bay bridge toll plaza as we see the backup forming in the cash lanes back to the end of the parking lot. we will likely see the metering lights turned on any second now. back to you. 6:08. construction on the biggest public works project kicks off in less than an hour. 7:00, roadway on the south bay's b.a.r.t. extension will start on hosstetter avenue. reduction in traffic lanes from 3 to 2 in both directions. >> there will be some delays during the peak commuter hours. commuters travel willing to work or taking their kids to school should allow extra travel time

to traverse the area safely. >> this is the first major road work being done in san jose for the south bay bart extension. they will start digging a trend for future b.a.r.t. trains below the road. a lot of work is being done to prepare the area for construction. the road work is expected to be done for nine months. the new extension is set to open in 2017. protest this morning to demand smaller classes and bigger paychecks. teachers in fremont say their class sizes have simply gotten out of control as a result of budget cuts. they also say they are not getting fair pay raises. the district has offered a compromise for teacher's demands. negotiations have stalled. teachers will be handing out fliers to parents at all fremont unified school campuses this morning. it is 6:10. a child star all grown up and under arrest in east bay. we are going to tell you why the

cyberbullying will speak publicly. they plan to file a wrongful death lawsuit against three 16-year-old boys that are facing sexual assault charges. bob redell live at juvenile hall where the suspects are being held. >> reporter: in five hours, the parents of this girl will hold that news conference to announce the wrongful death charges they plan on filing against the three 16-year-old boys they are detaining on felony charges for allegedly assaulting their 15-year-old daughter. their daughter, audrie pott, a sophomore, committed suicide eight days after three boys allegedly attacked her and texting and e-mailed specific photos of the assault to classmates. >> we have a sophomore in high school who should be worried about her next date at the prom and she is having to deal with the fact she was sexually assaulted while she was unconscious by three friends and

then afterwards, they rubbed her nose in it by these postings. >> on friday, the boy's attorney released this statement. much of what has been reported over the last several days is inaccurate. most disturbing is the attempt to link audrie's suicide to the specific actions of these three boys. the pott's attorney says they are not remorseful and that's why they are filing that wrongful death suit in santa clara court and speaking out publicly for the first time. they plan to push for audrie's law that would increase penalties for cyberbullying and sexual assault laws so teens can be tried as adults. those boys are expected to make their first court appearance live tomorrow. it is 6:15 right now. time for a quick check on the

day's top stories. an 88-year-old man in custody in berkeley after police say he shot a firefighter responding to a medical call at his house. one firefighter was grazed by a bullet. that man is undergoing a psychiatric evaluation. >> a compromise on immigration reform could come up for a volt in congress this week. the measure would help secure the border and create a path to eventual citizenship for undocumented workers who came to the country before 2012. a bipartisan group of lawmakers will unveil that bill tomorrow. an italian court considering possible indictment this morning against six crew members of the costa concordia cruise ship that ran aground last year. a total of 32 people died in that crash. the ship's captain facing manslaughter charges. china says its economy is not growing as quickly as hoped. >> scott mcgrew says that has investors all over the world a bit cautious. >> the second largest economy in the world, this morning, it

says, the economy there grew by just 7.7% in the first quarter compared to last year. those are numbers we would kill for here in the united states but by chinese standards, that is a slowdown. here at home, we are looking for a lower open on the markets partially because of those chinese numbers. yahoo! and google report profits. a reminder, today is tax day. silicon valley continues to come under fire overuse of tax money to fund green projects, sol indra, the classic example. bill owe ril'reilly taking a sh tesla and their government loans. tesla motors has net losses. this is another electric car, right? >> yes. >> $523 million in losses, in losses. >> he is reasonably accurate. he is not being entirely fair. tesla has lost money as every

elevation. winds pumping at speeds of 20-30 miles per hour, gusting to 50 from time to time. that's strong enough to knock you around in your high-profile vehicle. i want to show you the picture of san bruno this morning. we have some cloud cover. we might see a few showers. good monday morning to you. make sure you are ready for the weather today. it will likely impact you more on your way home from work than what we are experiencing this morning. winds are going to pick up. they will be the strongest between 11:00 a.m. and 9:00 p.m. a wind advisory in place for the entire bay area. strong winds on the way. the strongest gusts at the coast. san francisco is getting a straight wind out of the west at 19 miles per hour. we don't have any flight delays. they are possible, even probable by as we head through the day. the jetstream is taking a dip to the south. that's going to transport the real really strong winds. fog and drizzle on your way to

work. we will see the gustiest winds. if we do see any power outages, likely up there. mid-week warmup, our next weather event. we are talking about the warmest air of the year so far. i just said that a couple of weeks ago. we did hit the 90s. we could hit the mid-90s. today, the coolest day of the week. 62 for livermore. 64, good morning, redwood city. 63 degrees in los gatos. the 70s return by wednesday. we keep on climbing into the mid-70s. the 80s for thursday and friday. mid to upper 80s as we get into this weekend. first, check the drive. high, mike. >> 60s and 80s. we are going the opposite direction with the speed. the speed limit is still 65. even if you could drive that fast, you shouldn't. not a major backup. we had early slowing, 101 for san jose. 87 shows a slowing coming up into downtown. nothing major for the south bay

including that power pole that was down. that cleared from our reports as well through alum rock as well. south on the couple pampass. tri-valley, standard build. no surprises here. this is the surprise coming into the area. danville to san ramon, still jacked up. the earlier crash at krocanion road, we should see things start to thin out. backup goes in time for the brunt of the commute coming out of the walnut creek area. 24 and 680 still showing a smooth drive close to the speed limit. westbound 24 out of the area through lafayette. you are just fine there approaching the maze. the issue here is north 880. the first one cleared quickly. apparently, we had some crews on the scene. the second fender-bender that

occurred clearing quickly. now, more slowly north have the coliseum into downtown. 580, okay. bay bridge toll plaza, we did see what we expected. the backup for all these folks back past the 880 overcrossing toward the west grand avenue. also, the issue, let's look at the wide shot. with he see the camera trembles, winds already and have been overnight for the bay bridge. the chp has issued a wind advisory for the bay bridge and the san mateo bridge. we'll take a look at that. basically, any of your bridges that you commute across, you are going to hold on tighter because of those gusts. stronger winds throughout the morning. here, there is the commute westbound. a good load of traffic heading over where we are looking. traffic flows smoothly on the peninsula. back to you. it is 6:22 right now. major league baseball celebrating a major milestone. celebrating jackie robinson day. today marks 66 years since he

broke baseball's color barrier in 1947. he famously played for the brooklyn dodgers. no game scheduled out of new york. the l.a. dodgers will celebrate robinson with pre-game events and an onfield ceremony. all players and umpires, they will be wearing number 42 today. speaking of those dodgers, they will face the padres for the very first time since this big brawl broke out that left dodgers' pitcher, zach greinke with a broken collarbone and carlos quentin suspended. the dodgers tell the "l.a. times" they will not forget that scene. they do not retaliate against the padres. the dodgers team management says he expects umpires to warn both teams about any possible retaliation before the game starts. they do not want any kind of repeat of that mess. >> that got ugly fast. >> pippi longstocking in the east bay. we are going to tell you what

soaring are closed because of an employee injured last year while performing investigation. the famous matterhorn bobsled was just reopened today. the bay area actress that starred as pippi longstocking, put out in the late '80s, is speaking out on twitter. police say tammy errand was placed under citizen's arrest by her roommate after they began arguing inside their home on sunnyvale home on thursday. the male roommate is accusing her of assault. she accuses the roommate of filming her secretly without her knowledge. she says, quote, the truth will come out. gossip website says the case has been sent to the contra costa district attorney's office for review an out of control bus crash with a tour bus with bay area passengers on board. we will tell you about the

has been released from the pt. the shooting victim is undergoing a mentally valuation. "today in the bay's" kristy sch smith is talking to "today in the bay." in san jose, a police officer is injured after a burglary suspect hit him with a car near the hp pavilion. officers say the suspect had broken into a car when he was caught in the act by the person he was trying to steal from. the victim chased the suspect down the street until he jumped into a four-door integra, sped out on to the street and hit an officer who was doing traffic control. the officer's leg was injured. it was broken. the suspect is still on the loose. we will have live reports on both overnight incidents coming up at 6:45. >> compromise on a couple of controversial issues could come up for a vote. those two issues, immigration and gun control. ahe ahead. good morning. >> let's talk immigration first. marco rubio has tried to put himself out front on this. he was on seven different talk shows over the weekend talking about this bill we expect to come out tomorrow that he says will be compassionate but responsible in dealing with the 11 million people who are in this country illegally, many of them in california. it is not amnesty, he argued but some conservatives still very concerned about that and about putting more low wage workers into a system where we are already having challenges with unemployment. now, turning to gun control. also, a compromise there but, again, is it one that can pass not only the republican-controlled house but the senate where it was crafted. this would expand background checks to gun shows and internet sales. even the sponsors say they are not quite sure they have all the votes for this one. 53 is what we are counting. 60 is what they need to get that

passed. there are still nine democrats and republicans who haven't made up their mind. susan collins was the first republican to sign on, saying the people back home may not go for that compromise but she thinks it is a, quote, reasonable approach. we are waiting to see what will happen with that. likely, a vote on that one on wednesday. >> we will brace for a lot of head-butting on that one. 6:32. mechanics will begin inspecting a bay area tour bus. traveling on highway 41 saturday night when the driver lost control and crashed it into a tree just outside the park. all 16 passengers were hurt. the driver was not. the bus is owned by a tour company in burlingame. one chp officer says the driver told him the bus had a steering problem just before the crash. >> time to check out the weather. you may have noticed some wet roads out there. a look over san jose in the south bay as christina loren

we have 680 south which continues a slow drive south of walnut creek headed back down into danville. we have more slowing. a new crash reported. the first crash at san rho moam the bottom. a slow drive through this corridor, not a great alternate for you. it sounds like they are making good progress on this second of the crashes here. we have your tri-valley with some slowing. the south bay with your northbound build. 101 and 87 showing the difference colors there. the rest are green. a live look at 101. the volume, pretty steady here, north from 680, 280 up toward mckie. an eight-year-old boy is lucky to be alive after his heart stopped after being hit by a pitch during a little league game. he was at-bat when he watts hit by a pitch. he took five steps towards first base and then collapsed. spectators rushed to the boy

the costa concordia back after running aground more than a year ago. a major salvage is underway to stabilize the wreck before it can be towed to shore. they are weighing possible indictments against the crew including the captain. he is facing manslaughter charges for causing the dits

♪ the one and only, cheerios an update to breaking news in berkeley where police have arrested an 88-year-old man for allegedly shooting at firefighters responding to an emergency at his house. it happened on dwight qua near san pablo avenue. christie smith is live in berkeley with new details. kristy? >> reporter: good morning to you. i just got off the phone with the interim fire chief for the berkeley police department. he tells me this injured firefighter will be debriefed and then go home to spend time with his family after a very close call here at this home on

twit w dwight way. firefighters came here on a medical cover after an 88-year-old man inside opened fire. that according to berkeley police this morning who were called to the scene to help around 1:45 this morning at the home police say that 88-year-old man shot at firefighters. one firefighter was grazed and treated at the scene. why this man may have done this, police say they still don't know. all five of the firefighters inside made it out of the home. they called police and the man barricaded himself inside the home. >> it is a little unusual for us to have this type of incident. i'm sure the fire department, that's not what they expected when they had to respond for this type of call for service. thankfully, there was only a minor injury to one firefighter. there was no further injuries to police personnel or the gentleman or any of his family. >> that elderly man eventually

surrendered. police spent quite a few hours here gathering evidence. another person was inside the home and made it out okay. an elderly man was taken to the hospital for a mental health evaluation after police gathered statements to decide whether or not criminal charges will be fired. the interim police chief telling you that the last time firefighters were shot at here in berkeley was in 2007. at that time, two firefighters were hit but they both recovered. reporting live in berkeley, christie smith, t"today in the bay." >> firefighters in other are the ps country have been targeted. a gunman held four firefighters inside a home in atlanta. he was shot dead by a s.w.a.t. team. all four firefighters are recovering from minor injuries on christmas eve, two firefighters were killed and two others injured after a man set fire to his home and ambushed firefighters in upstate new york.

the day. if you are ready for the wind. at the coast, we are getting the strongest gusts. nothing too strong. we will have rough seas. it is dangerous for you to be out there in the watter it. not a great day for the boat. that's going to transport the strong winds and carrying a few more showers mostly toward the coastline. the gusty north winds will be the big weather story today and that goes for tomorrow as well. wednesday through thursday, big ridge of high pressure moves in to boost that storm track back to the north. jetstream takes a hike to the north. temperatures on the climb significantly as a result. look at start of your seven-day. 62 today, 54 at the coast. at the end of your seven-day, we're talking about a return potentially of the 90s looking pretty likely as we get into sunday. make sure you are ready for the warmup. particularly for the wind today. mike is here to help you out in that department. >> my advice, hold on, because it is windy right now and has

been overnight across some of the bay area bridges. christina is talking about the national weather service issuing that advisory. that's very significant. we are looking at north 87 and north 85. we had the slowing northbound to southbound. i switched the slowdown. basically, the shorthand of this is it is starting to build throughout your commute areas for the south bay. 101 slow from the capital expressway to the airport. we are looking at the tri-valley with the build here. a good volume of traffic kicking in. starting to slow south from pleasanton to sunol. there is your monday build. south 680 coming out of walnut creek through danville, earlier crashes over here in crocrain road and el panata. this is typically the time we see the slowdown starting. it got a good head start slow

"today in the bay's" marla tallez live near the pavilion in downtown san jose. she has the rest of the story. good morning. >> this happened late last night soon after a concert let out at hp pavilion. it is just about a quarer it te mile away to my right. you can imagine thousands of people in the streets when this happened. the officer was hit by the suspect right here at the intersection of delmas and san fernando. he had just broken into a parked car when he was caught by the vehicle's owner trying to make a getaway. he jumped into his own car, a late model acura tl. he was going 40 miles an hour down delmas the wrong way when he hit the officer trying to direct traffic. lieutenant mike sullivan tells me, since then, they have made more than half a dozen stops on similar-looking vehicles but still have not found this guy. >> we got, we think, a partial plate. we will put in the system and

campus. the suspect got into an argument with the victim back on april 1st. punched him, knocking him to the ground. he was last seen at bancroft near the south side of hearst gym. palo alto police releasing this photo of a man accused of robbing a credit un yn ion on e camino real. police say he never took out a weapon. he may have driven away in a silver or gray thunderbird. the same credit union was robbed in january. the two cases are not linked. the parents of a high school sophomore who killed herself after an alleged sexual assault that involved cyberbullying will speak out for the very first time. they are now filing a wrongful death suit against three teenage boys accused in this assault. bob redell is live at juvenile hall where the boys await a court appearance. good morning. >> good morning to you, jon.

those three 16-year-old boys locked up at the juvenile detention center are supposed to make their first court appearance tomorrow. as for the parents of audrie pott, she is the 15-year-old girl they are accused of sexually assaulting. they will hold a news conference to announce they are filing a wrongful death suit against those teens. they will also be the first time speaking publicly about what happened to their daughter. their daughter, a sophomore at saratoga high killed herself out of humiliation. eight days prior, the three boys who are friends allegedly sexually assaulted her and texted an e-mail with explicit photos of the attack to several classmates. on friday, the boys' attorney released this statement. much of what's been reported is inaccurate. most disturbing is the attempt to link audrie's suicide to the specific actions of these three days. the reactions from audrie pott's

parents. this tells us they are still in denial. the parents plan to push for audrie's law that would increase penalties for cyber bullying and strengthen sexual assault laws so teens can be tried as adults in cases like these. they have been in touch with state senator, jim bell. bob redell, "today in the bay." a federal jury investigating a file. last week, the u.s. chemical safety board released a detailed report into the cause of the august fire. the investigation concludes corroded piping led to the leak and blames the state's regulatory agency for not being proactive enough. the board plans to discuss the report and safety recommendations at a news conference this morning in emeryville. a public meeting on the findings
